Jakarta - PT Pertamina (Persero) and the Attorney General of the Republic of Indonesia today signed a memorandum of understanding (MoU) to optimize the implementation of duties and functions in the Civil and State Administration related to rescuing state assets. The MoU is signed by President Director of Pertamina Elia Massa Manik and Deputy Attorney General for Civil and State Administration Bambang Setyo Wahyudi in Jakarta on Tuesday (18/04).
The MoU covers three important agreements namely; Providing legal assistance, giving legal considerations, and other tasks of a mediation and facilitation if there is a dispute between Pertamina as a State Owned Company with another party in the Civil and State Administration field.
According to President Director of Pertamina Elia Massa Manik, the signing of this agreement is part of the Company's efforts to improve the effectiveness of handling legal issues in civil and state administrative law both inside and outside the court faced by Pertamina and its subsidiaries.
"We seek to protect state assets managed by Pertamina, and it is expected that law enforcement agencies will have the same objectives and fully support the rescue of state assets by Pertamina," he said.
Deputy Attorney General for Civil and State Administration Bambang Setyo Wahyudi said the AGO will provide legal assistance and accompaniment to Pertamina. As a state-owned enterprise which 100% of its shares are state-owned and controlling the asset in the energy sector from the East to the West end of the archipelago, and managing strategic projects for the country in the energy sector, Bambang said Pertamina must face many obstacles, including obstacles in the Civil and State Administration Law field.
"The presence of the Attorney General's Office to assist Pertamina is expected to have a positive impact on Pertamina's effectiveness in conducting its role for securing the national energy," said Bambang.
In its implementation, such cooperation shall provide assistance, considerations and other legal actions to be carried out by the Government Law Attorney (GLA) in recovering and rescuing financial, property, assets, and other problems in the civil and state administrative law field faced by Pertamina and its subsidiaries.
Related to this, previously Pertamina and the Attorney General has been stated in the Joint Agreement no. 07 / C00000 / 2014-S0 / No. B-168 / G / Gs.1 / 06/2014, dated June 16, 2014. However, this two-year agreement had expired on June 16, 2016. The new agreement No. 06 / C00000 / 2017-S0 / No. B-167 / G / Gs.1 / 04/2017 which signed today will also take place over the next two years and will expire in May 2019.
